Proof of Work Relation
A proof of work relation can be:
- a work contract,
- an agreement on performing work (in Czech DPČ),
- a preliminary contract/agreement in which the parties (the employee and the employer) commit to close a work contract or an agreement on performing work within an established time limit.
An agreement on completing a job (in Czech DPP) cannot be used as a proof of work relation. It is not possible to issue an employee card based on an agreement on completing a job, nor is it possible to consent to a change of employer or employment on a different or another work position based on such an agreement.
A work contract must always include:
- The signature of both parties. The work contract can be signed by the foreigner’s authorised representative (e.g. his/her attorney).
- Nature of work to be done.
- Place (or places) of work.
- The first day of work. It does not need to include a concrete date but the first day needs to be somehow specified. For example: “the day following the day on which the applicant has received the Confirmation of Compliance with the requirements for issuance of the employee card.
An agreement on performing work must always include:
- The signature of both parties. The work contract can be signed by the foreigner’s authorised representative (e.g. his/her attorney).
- Agreed work to be done.
- Period for which the agreement is closed.
- Working hours.
It must be also clear from the document that:
- The weekly working hours shall amount to at least 15 hours.
- Regardless of the number of working hours, the monthly wage, salary or remuneration will be higher than the basic minimum monthly wage.
A proof of work relation must be provided as an original or as a certified copy.
